General Terms and Conditions – Mud & Glass

1. General
1.1 These general terms and conditions apply to all offers, orders and agreements between blubber & glas, located at Hogemorsweg 130 Leiden, registered with the Chamber of Commerce under number 78588820, and the customer.
1.2 By placing an order, the customer agrees to these terms and conditions.
2. Products
2.1 The products are handmade. Slight variations in color, shape, and size are characteristic of handmade ceramics and do not constitute grounds for complaint.
2.2 Images on the website or in printed materials are indicative.
3. Prices and Payment
3.1 All prices are in euros, including VAT (unless otherwise stated), excluding shipping costs.
3.2 Payment must be made in advance, unless otherwise agreed in writing.
4. Delivery and Shipping Costs
4.1 Delivery times are indicative and do not constitute a strict deadline.
4.2 Blubber & Glas is not liable for delays by postal or parcel services.
4.3 Shipping costs will be communicated in advance.
5. Warranty
5.1 Blubber & Glas guarantees that the delivered products comply with the agreement, the stated specifications, and the reasonable requirements of soundness.
5.2 The warranty period for consumers is 6 months, starting from the delivery date. See our statutory warranty conditions for handmade ceramics.

6. Complaints and Returns
6.1 Complaints about visible defects must be reported in writing within 7 days of receipt, preferably with photographs.
6.2 If a complaint is justified, the customer is entitled to repair, replacement or refund.
6.3 Returns must be reported and approved in advance. The customer bears the risk and costs of return shipping, unless otherwise agreed.
6.4 Custom-made products cannot be returned unless there is a manufacturing defect.
7. Liability
7.1 The liability of blubber & glas is limited to the purchase price.
7.2 Blubber & Glas is not liable for indirect damages, such as consequential damages, loss of profits, or injuries due to misuse.
8. Force Majeure
8.1 In the event of force majeure (such as natural disasters, pandemics, fire, strikes), blubber & glas is entitled to suspend or cancel the agreement without compensation.
9. Privacy
9.1 Personal data will be processed in accordance with the GDPR and will only be used for the performance of the agreement.
10. Applicable law
10.1 Dutch law applies to all agreements.
10.2 Disputes will be submitted to the competent court in the district where blubber & glas is established.
11. Individual workshops
11.1 Registration for a workshop is binding after receipt of payment or written confirmation of participation.
11.2 In case of cancellation by the customer:
11.3 Cancellation by Mud & Glass due to insufficient participants, force majeure, or illness of the instructor entitles you to a full refund or rebooking to another date.
11.4 Participants participate in the workshop at their own risk. blubber & glas is not liable for injury, damage to clothing, or property, unless there is intent or gross negligence.
11.5 Workshop results (such as your own work) are fired and can be picked up or shipped at a later date (optional, for a shipping fee). Due to the nature of the firing process, variations in color or shape may occur.
11.6 Participants agree to the possible use of atmospheric photos of the workshop (without mentioning their name) for promotional purposes, unless prior written objection is made.
